利用規約Terms of Service

この利用規約（以下、「本規約」といいます。）は、Hekaxion（以下、「当方」といいます。）が提供するゲームアプリ「Rust Axion」（以下、「本アプリ」といいます。）の利用条件を定めるものです。本アプリをご利用になるユーザーの皆様（以下、「ユーザー」といいます。）には、本規約に従って本アプリをご利用いただきます。
第1条（適用）
- 本規約は、ユーザーと当方との間の本アプリの利用に関わる一切の関係に適用されるものとします。
- ユーザーは、本アプリを利用することにより、本規約のすべての記載内容について同意したものとみなされます。
第2条（禁止事項）
ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。
- 法令または公序良俗に違反する行為
- 犯罪行為に関連する行為
- 当方、本アプリの他のユーザー、または第三者のサーバーもしくはネットワークの機能を破壊したり、妨害したりする行為
- 本アプリの運営を妨害するおそれのある行為
- 他のユーザーに関する個人情報等を収集または蓄積する行為
- 不正アクセスをし、またはこれを試みる行為
- 本アプリの不具合（バグ）を意図的に利用する行為
- 自動操作ツール、マクロ、クリッカーアプリ等の外部プログラムを利用して本アプリを不当に操作する行為
- iOS の「スイッチコントロール」機能等、OS 標準のアクセシビリティ機能を本来の目的から逸脱して本アプリの自動操作・連続操作に用いる行為
- その他、当方が不適切と判断する行為
第3条（本アプリの提供の停止等）
- 当方は、以下のいずれかの事由があると判断した場合、ユーザーに事前に通知することなく本アプリの全部または一部の提供を停止または中断することができるものとします。
- 本アプリにかかるコンピュータシステムの保守点検または更新を行う場合
- 地震、落雷、火災、停電または天災などの不可抗力により、本アプリの提供が困難となった場合
- コンピュータまたは通信回線等が事故により停止した場合
- その他、当方が本アプリの提供が困難と判断した場合
- 当方は、本アプリの提供の停止または中断により、ユーザーまたは第三者が被った不利益または損害について、第5条に定める範囲で責任を負うものとします。
第4条（利用制限および登録抹消）
- 当方は、ユーザーが以下のいずれかに該当する場合には、事前の通知なく、ユーザーに対して本アプリの全部もしくは一部の利用を制限し、またはユーザーとしての登録を抹消（データ削除・アクセス拒否を含む）することができるものとします。
- 本規約のいずれかの条項に違反した場合
- 当方からの連絡に対し、一定期間返答がない場合
- その他、当方が本アプリの利用を適当でないと判断した場合
- 当方は、本条に基づき当方が行った行為によりユーザーに生じた損害について、第5条に定める範囲で責任を負うものとします。
第5条（免責事項）
- 当方は、本アプリに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます。）がないことを明示的にも黙示的にも保証しておりません。
- 当方は、本アプリに起因してユーザーに生じた損害について責任を負いません。ただし、当方の故意または重大な過失による場合、および消費者契約法その他の法令により免責が認められない場合はこの限りではありません。
- 前項ただし書きが適用される場合であっても、当方が負う損害賠償の範囲は、通常生じうる損害の範囲に限られ、かつ当該ユーザーが本アプリに関して当方に支払った金額を上限とします。
第6条（本規約の変更）
- 当方は、必要と判断した場合には、本規約を変更することができるものとします。
- 変更後の本規約は、当方のウェブサイト（https://hekaxion.com/terms/）に掲載した時点から効力を生じるものとします。ユーザーに重大な影響を及ぼす変更を行う場合は、あらかじめ本アプリ内でもお知らせします。
第7条（準拠法・裁判管轄）
- 本規約の解釈にあたっては、日本法を準拠法とします。
- 本アプリに関して紛争が生じた場合には、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Service (English)
These Terms of Service (the "Terms") set out the conditions for using the game application "Rust Axion" (the "App"), provided by Hekaxion ("we", "us"). Users of the App agree to use it in accordance with these Terms. This is a reference translation; in the event of any discrepancy, the Japanese text above prevails.
1. Scope
- These Terms apply to every aspect of the relationship between the user and us concerning use of the App.
- By using the App, the user is deemed to have agreed to all provisions of these Terms.
2. Prohibited Conduct
When using the App, users must not:
- violate any law or public order and morals;
- engage in conduct connected with criminal activity;
- damage or interfere with the servers or networks of us, other users, or third parties;
- engage in conduct that may interfere with the operation of the App;
- collect or store personal information about other users;
- gain or attempt to gain unauthorised access;
- intentionally exploit defects (bugs) in the App;
- manipulate the App improperly using external programs such as automation tools, macros or auto-clickers;
- use OS accessibility features such as the iOS "Switch Control" beyond their intended purpose to automate or repeat operations in the App;
- engage in any other conduct we deem inappropriate.
3. Suspension of the App
- We may suspend or interrupt all or part of the App without prior notice where: system maintenance or updates are carried out; provision becomes difficult due to force majeure such as earthquake, lightning, fire, power failure or natural disaster; computers or communication lines stop due to an accident; or we otherwise judge that provision has become difficult.
- Our liability for any disadvantage or loss arising from such suspension is as set out in section 5.
4. Restriction of Use and Deletion of Registration
- We may, without prior notice, restrict all or part of a user's use of the App, or delete their registration (including deleting data and refusing access), where the user breaches any provision of these Terms, fails to respond to our contact for a certain period, or where we otherwise judge their use of the App to be inappropriate.
- Our liability for any loss arising from action taken under this section is as set out in section 5.
5. Disclaimer
- We make no express or implied warranty that the App is free from defects in fact or in law — including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose or security, and including errors, bugs and infringement of rights.
- We are not liable for loss arising from the App. This does not apply where the loss results from our wilful misconduct or gross negligence, or where liability cannot be excluded under the Consumer Contract Act or other applicable law.
- Even where the proviso above applies, our liability is limited to ordinary foreseeable loss and capped at the amount the user has paid to us in connection with the App.
6. Changes to These Terms
- We may change these Terms where we judge it necessary.
- Amended Terms take effect when published at https://hekaxion.com/terms/. Where a change materially affects users, we will also give notice within the App in advance.
7. Governing Law and Jurisdiction
- These Terms are governed by and construed in accordance with the laws of Japan.
- The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute concerning the App.
